White Cake Bake-Off Contest Rules
NOTICE TO ONLINE ENTRANTS
In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the "Authorized Account Holder" of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Sponsor is not responsible for: (i) lost, late, misdirected, damaged or illegible entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in this Contest. By participating in the Contest, you (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor and the independent judging organization, which are final and binding in all matters relating to the Contest. Failure to comply with these Official Rules may result in disqualification. Contest Sponsor reserves the right to: (i) permanently disqualify from any Contest it sponsors any person it believes has intentionally violated these Official Rules; and (ii) withdraw the online method of entry if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Contest), and to select winners from among all eligible entries received prior to withdrawal.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEB SITE OR INTERFERE WITH THE OPERATION OF THIS CONTEST, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
Eligibility: The 2012 Southern Living “White Cake Bake-off” (the “Contest”) is open to legal residents of the 50 United States, and the District of Columbia (U.S.), age 18 or older at time of entry. Void outside the United States, in Puerto Rico, and wherever else prohibited by law. Employees and contributors of Southern Living Magazine, a division of the Time, Inc. Lifestyle Group (the “Contest Sponsor”) and its subsidiaries, affiliates, advertising and promotion agencies and individuals, prize providers, and the immediate family members of and/or those living in the same household of each (collectively, the “Contest Entities”), are not eligible to enter. This Contest is subject to all applicable federal, state, and local laws and regulations.
Contest Entry. There are Two (2) ways to enter – Online and by Mail.
• Online: To enter online, visit our website at www.southernliving.com/big-white-cake and follow the directions provided. Online entries must be received between 12:01 AM Eastern Time ("ET") on Tuesday, May 15, 2012 and 11:59 PM Eastern Time (“ET”) on Saturday, June 30, 2012 (the “Contest Entry Period”). Only one individual may submit an entry at one time and only one entry for a specific named recipe will be eligible. Duplicate entries for the same recipe are not allowed.
• Mail: You may also enter by mailing your recipe to: Southern Living “White Cake Bake-off”, c/o Pat York, 2100 Lakeshore Drive, Birmingham, Alabama, 35209. Each mailed entry must be submitted on a separate sheet of paper, including your name and complete address, must be postmarked no later than Saturday, June 30, 2012 and received no later than Tuesday, July 10, 2012.
There is no limit to the number of online or mail-in entries you may submit, but each recipe must be submitted by one person only and must be original, unpublished, tested in your home kitchen, and may not have won any other recipe contest. Duplicate entries for the same recipe are not allowed. Entries will not be acknowledged or returned. Sponsor is not responsible for incomplete, illegible, lost, late, mutilated, misdirected or postage-due mailed entries or for transmission defaults, computer server failure and/or delayed, garbled or corrupted data transmissions for entries submitted via the Internet.
By entering this contest, you grant the Contest Sponsor reserve the right to edit, adapt, copyright and publish any or all recipe entries and to use these entries in any media form or in any manner without attribution or further compensation.
• Enter Your Cake Recipe: Each recipe (including batter, frostings, and fillings) must contain exact ingredient amounts, specific preparation instructions, pan sizes, bake temperatures and times, and how to assemble the cake (e.g., Specify how much filling to be used between each layer and how to frost the cake).
• Recipe Inspiration: Share your recipe inspiration (optional). List any comments or family memories about the inspiration for your holiday recipe.
• Finished Cake: All or part of the outside of the finished cake must be white. Garnishes and decorations are optional. Contest Sponsor reserves the right to change any decorative elements for photography purposes.
If selected for testing, recipes may be modified to meet Southern Living recipe editing guidelines and reader appeal.
Judging and Prizes: There will be three (3) recipes selected, one (1) Grand Prize Winner and Two (2) Runners-up. Judging will be based on the following criteria: taste (50%) and originality (50%). The Southern Living Food staff will determine two runners-up and the Grand Prize winner via a recipe taste-testing period that will take place from Monday, July 2, 2012 through Friday, August 31, 2012.
In the event that a recipe includes an ingredient that cannot be easily supplied for taste-testing, Southern Living reserves the right to provide a substitute ingredient that is similar to the original ingredient. If, for any reason, the Contest is not able to be conducted as planned because of circumstances or causes, which, in Contest Sponsor’s sole opinion, affect the security, fairness or proper conduct of this event, they reserve the right to modify the location, structure or nature of the judging.
One (1) Grand Prize Winner and Two (2) Runners-up will be notified on or before Friday, October 5, 2012.
Grand Prize winner and two Runners-up will be notified by phone or email and confirmed in writing, and will be required to sign and return, within ten (10) days of winner notification, an affidavit certifying his/her recipe’s originality and his/her eligibility, a release of liability, and a grant of ownership rights of the recipe to the Contest Sponsor.
Prizes will be sent to the address on the entry form or new address provided on the affidavit within 4-6 weeks of winner being notified.
If someone cannot be reached at the phone number provided or if a prize notification or prize is returned as undeliverable, it will result in disqualification, and the prize will be awarded to an alternate winner in a separate random drawing. If a winner is otherwise eligible under these Official Rules, but is nevertheless deemed a minor in his or her state of primary residence, his/her prize will be awarded in the name of his/her parent or legal guardian who must execute the Releases on the minor winner’s behalf. Prizes are non-assignable or transferable to another individual, except to a surviving spouse.
The Contest Sponsor will conduct a photo shoot, at their expense, and create a cover of the Grand Prize Winning Recipe and a magazine article showcasing the finalists’ recipes, which will run in the December 2012 issue of Southern Living (on-sale 11/16/2012). Winning entries will also be featured at the Sponsor Host’s website www.southernliving.com.
TOTAL Approximate Retail Value ("ARV") of all prizes to be awarded: $4,000.
One (1) Grand Prize Winner will have his/her winning recipe featured on the December 2012 cover of Southern Living magazine, receive a $1,000 cash prize, and visit the Southern Living Test Kitchen in Birmingham, Alabama. TOTAL ARV: $3,000.
Two (2) Runners-up will each have his/her recipe featured in a Food story in the December 2012 issue of Southern Living magazine, and each will receive a $500 cash prize. Total ARV: $1,000.
Prize Conditions: Prize is non-assignable or transferable. No substitution is permitted except if prize is unavailable, in which case a prize of equal or greater value will be awarded. No exchange or substitution of prize, except at the sole discretion of the Sponsor. Any other incidental expenses on prize not specified herein are the winner’s sole responsibility.
Winners are responsible for all federal, state and local taxes, if applicable. Grand Prize Winner’s Affidavit/Release will require that the Winner provide their Social Security Number, which will be used for tax reporting purposes only. Entry and acceptance of any prize constitutes permission for Sponsor or their agent(s) to use winner’s name, recipe submission, prize won, hometown and likeness for online posting and promotional purposes without further compensation, except where prohibited by law. Prizes are guaranteed to be awarded.
Legal Notices: Contest Entrant warrants that with respect to his/her entry, the submitted recipe does not infringe on any copyrights or intellectual property rights, is original and has never been published or previously awarded a prize in a recipe contest. By entering this Contest, all Entrants agree to abide by the Official rules, the decisions of the judges and to release and hold the Contest Entities harmless from any and all claims and liability with respect to the conduct, administration and execution of the Contest. Entrant agrees that his/her entry becomes the property of Southern Living and hereby assigns his/her intellectual property rights to Contest Sponsor and also permits participating Sponsors to use the recipes in any media, including on the Internet, for commercial, editorial, or any other purpose whatsoever, without compensation, except where not allowable. Contest Sponsor is not responsible for any typographical or other error in the printing of the Contest Rules, promotional materials, the administration of the Contest or in the announcement of the prizes. All federal, state, and local regulations apply.
Winner Confirmation: Name of Recipe Contest Winners will be posted on www.southernliving.com and published in the December 2012 issue of Southern Living Magazine.
